Custom Portrait Terms & Conditions
By commissioning a custom artwork from Isabel Acland at Acland Art, you agree to the following terms and conditions.

1. Commission Bookings
Acland Art provides bespoke artwork commissions, including portraits of people, pets, motorsport subjects, and other custom requests.
To confirm a commission and reserve a place in the schedule, a non-refundable deposit equal to 50% of the agreed commission fee is required. The remaining balance becomes payable once the artwork has been completed and approved by the client, and must be paid before the artwork is dispatched.
Examples of previous commissions can be viewed in the website gallery to help you understand the artist's style, techniques, and quality standards.
2. Artwork Approval
Adjustments to the artwork may be requested if it is not up to your satisfaction. If, after appropriate amendments have been made, you decide not to proceed with the completed artwork, the initial deposit will be retained. In this situation, no further payment will be due and the remaining balance will be waived.
3. Cancellations and Deposits
Because commissioned artwork is created specifically for each client, deposits are non-refundable.
Should you cancel the commission after work has commenced, any deposit already paid will be forfeited and no refund will be issued.
4. Packaging and Delivery
All completed artwork is carefully packaged using protective materials to minimise the risk of damage during transit.
Packages will be clearly labelled with handling instructions where appropriate. Unless alternative arrangements have been agreed, artwork will be shipped using a first-class postal service.
5. Shipping Risks and Insurance
Reasonable care will be taken to ensure artwork is securely packaged before dispatch. However, Acland Art cannot accept responsibility for delays, loss, or damage caused by postal or courier services.
Where postal insurance is available and applicable, any successful claim may be used to recreate the commissioned artwork so that the customer is not financially disadvantaged.
6. Copyright and Ownership
Unless otherwise agreed in writing, all intellectual property rights and copyright in commissioned artwork remain the property of Isabel Acland and Acland Art.
Website users may not reproduce, distribute, publish, resell, or commercially exploit the commissioned artwork without prior written permission.
7. Public Display Rights
Unless agreed otherwise in writing, Isabel Acland and Acland Art restrains the unrestricted right to post, display, reproduce and promote any commissioned artwork on social media platforms, personal or business websites, portfolios, advertising materials, exhibitions, and other promotional media.
Commissioning an artwork does not guarantee the client the right to restrict Isabel Acland use of the artwork for promotional or portfolio purposes.
8. Consumer Rights and Governing Law
As commissioned artwork is made to a customer's individual specifications, it may be exempt from cancellation rights that would otherwise apply to standard online purchases under applicable consumer legislation.
By paying the commission deposit and authorising work to begin, you acknowledge that the artwork is being created specifically for you.
These terms shall be governed by the laws of England and Wales. Any disputes arising in connection with a commission will be subject to the exclusive jurisdiction of the courts of England and Wales.
By placing a commission with Acland Art, you confirm that you have read, understood, and accepted these terms.

Payments must be made using the payment methods specified by Acland Art and will be processed securely.
4. Delivery
Delivery timeframes are provided as estimates only and cannot be guaranteed.
We are not responsible for delays caused by postal operators, couriers, customs authorities, or other third parties involved in the delivery process.
Customers are responsible for supplying a correct delivery address at the time of ordering.
Ownership and responsibility for the goods pass to the customer upon successful delivery by the carrier.
5. Returns and Refunds
As all commissioned portraits and custom artwork are created specifically for the customer, returns and refunds are generally unavailable unless an error has been made by Acland Art.
6. External Websites and Third-Party Services
This website may contain links to external websites operated by third parties.
Acland Art does not control and is not responsible for the content, security, availability, or policies of third-party websites.
Certain website features may be provided through Squarespace or other third-party providers, whose own terms and policies may also apply.
7. Intellectual Property
All website content, including text, images, branding, artwork, graphics, and logos, remains the property of Acland Art unless otherwise stated.
No part of the website may be copied, reproduced, distributed, modified, or commercially exploited without prior written consent.
8. Limitation of Liability
To the fullest extent permitted by law, Acland Art shall not be liable for any indirect, incidental, consequential, or special losses arising from the use of the website, products, or services.
Nothing in these terms excludes liability where such exclusion would be unlawful.
9. Amendments to These Terms
We may revise these Terms of Service from time to time.
